What the law actually requires

Wisconsin's Condominium Ownership Act at Wis. Stat. § 703.163 requires the declarant of a condominium created on or after November 1, 2004 to establish a statutory reserve account when the condominium is created, unless the declarant elects under § 703.163(3)(c) not to establish one. A statutory reserve account statement must be recorded with the register of deeds of the county where the condominium instruments are recorded.

Under § 703.163(6)(b), an association may terminate an existing statutory reserve account at any time by the written consent of a majority of the unit votes. This majority-vote waiver right applies to accounts established for condominiums created on or after November 1, 2004 as well as to older ones — it is not limited to pre-2004 condominiums. The one restriction: a reserve account established by a declarant may not be terminated until after any period of declarant control has expired.

Section 703.163 also does not apply at all to a small condominium unless the declarant or the association elects, by written consent of a majority of unit votes, to be governed by it (§ 703.163(2)(a)2). Where the section does apply, it directs the declarant and association to consider factors such as component condition, useful life, and current replacement cost when setting reserve contributions — but § 703.163 does not require a formal reserve study, impose a mandatory study cycle, or set a minimum funding percentage.
